S1303 – This is a bill that would virtually eliminate employment of illegal aliens in Idaho through the mandating of E-Verify to be used in hiring.  It is a free, easy and accurate program that verifies whether or not people are authorized to work in the US.  The expected result would be large amounts of voluntary deportation because illegal aliens wouldn’t be able to find work. This bill also included stiff penalties for employers who knowingly hire illegal aliens including loss of business license after three offences.

S1295 - Adds to existing law to allow the State Tax Commission authority to investigate joining the Streamlined Sales and Use Tax Agreement.

H0381 - TAX COMMISSION - Amends existing law to clarify the definition of "net operating loss" and to provide that net operating losses of a corporation will survive a merger subject to certain conditions.

S1329 - SAFE BOATING ACT - Amends existing law relating to Idaho Safe Boating Act to revise notice and reporting requirements relating to collisions, accidents and casualties.

S1256 - EXECUTIONS - Amends existing law relating to executions to revise provisions relating to the right of the court to stay execution and to remove reference to certain Idaho Code sections.

S1371 - PRODUCER LICENSING - Adds to and amends existing law relating to producer licensing to revise requirements and authority relating to the licensing of bail agents; to provide notice requirements; to clarify the Department of Insurance's responsibility relating to a surety performance bond; to provide a procedure to stay a certain obligation, to grant the administrative district judge authority to order the sheriffs and clerks of certain counties not to accept the posting of new bail bonds from certain surety insurance companies; and to provide a process and requirements for addressing a potential suspension of a bail agent's license.

H0443 - CRIMINAL HISTORY RECORDS - Amends existing law relating to criminal history records and crime information to revise provisions relating to fingerprinting and identification.

S1308 - DISPOSITION OF REMAINS - Amends existing law relating to disposition of remains to provide that in the absence of a prearranged funeral plan or certain provisions in such plan, that disposition of the remains of a decedent may vest in the person designated by the decedent in a DD Form 93, if the decedent died while serving in military service in any branch of the United States Armed Forces, United States Reserve Forces or National Guard.

H0444 - FIREARMS, EXPLOSIVES AND DEADLY WEAPONS - Amends existing law relating to firearms, explosives and other deadly weapons to revise application requirements for a license to carry concealed weapons.

H0471 - INCOME TAX - Amends existing law relating to income tax to provide for constituting certain income distributed to beneficiaries of an estate or trust as Idaho source income.  

H0615 - OPPORTUNITY SCHOLARSHIP - Adds to existing law to allow taxpayers to designate income tax refunds or donations to the Opportunity Scholarship Program Account.

H0543 - FIREARMS, EXPLOSIVES AND OTHER DEADLY WEAPONS - Adds to and amends existing law relating to firearms, explosives and other deadly weapons to provide for unlawful acts relating to a hoax destructive device and to provide penalties.

S1398 - MOTOR VEHICLES - CRIMES - PUNISHMENT - Amends existing law relating to motor vehicles and crimes and punishment to revise certain penalty provisions.

S1360 - SAFE BOATING ACT - Amends existing law relating to the Safe Boating Act to provide that it shall not be a violation to operate a motorboat equipped with devices provided by the manufacturer as stock equipment that are not used to exceed certain noise levels and to provide an exception from responsibility for motorboat dealers relating to certain noise restrictions.

Sen. Jorgenson sponsored a bill to further protect vulnerable adults from physical and sexual abuse. This bill passed 30-0-5 in the Senate, 66-0-4 in the House, and was then signed by the Governor.

Sen. Jorgenson sponsored a bill that helps victims of crimes, such as drunk driving, collect restitution. This bill passed 35-0 in the Senate, 67-0-3 in the House and was then signed into law by the Governor.

Sen. Jorgenson brought fourth a bill that ushers in monetary protection for Idaho’s heroes injured in the line of duty, such as firefighters and peace officers. This bill has been of close and personal importance to Sen. Jorgenson. This bill passed 34-1 in the Senate, 67-0-3 in the House and was then signed into law by the Governor.

Sen. Jorgenson sponsored a bill to protect users of motor boats from prosecution due to factory installed parts. This bill passed 27-8 in the Senate and introduced into the House.

Sen. Jorgenson sponsored a bill to protect the privacy of retired peace officers who choose to carry concealed weapons. This bill passed 34-0-1 in the Senate, 57-0-13 in the House, and is awaiting a signature by the Governor.

Sen. Jorgenson sponsored a bill that would hold Idaho employers who hire illegal immigrants accountable, for their crimes. This bill was shelved in the State Affairs committee by a chairman who is beholden to special interests that actively provide support to those who hire and maintain employees illegally residing in the United States. Sen. Jorgenson will continue to push this bill until employers who hire illegal immigrants are punished for their crimes.

Sen. Jorgenson sponsored a bill that would eliminate a physical tax stamp on all liquor distributed legally by the Idaho State Liquor Dispensary. This will save Idaho up to $1 million a year, by eliminating this expensive and labor intensive process, while having no effect on revenue brought in by the liquor tax in Idaho. This bill passed the Senate 34-0-1 and is awaiting a vote in the House.

Sen. Jorgenson sponsored a bill to protect small business owners who own liquor licenses by providing more options to pay the state liquor tax. This bill passed the Senate unanimously, the House by a margin of 69-0-1 and was signed into law by the Governor.

S1247 - THEFT - Amends existing law relating to defenses to a charge of theft of property to revise provisions relating to the unlawful retention of the property of another.

S1272 - DISTRICT COURT REPORTERS - Amends existing law to revise court reporter salaries; and to delete provisions regarding salaries and the order of transcripts prepared.

S1273 - ANIMALS - Amends existing law to revise the crime of committing cruelty to animals.

S1320 - PRISONERS - Amends existing law to provide that the Board of Correction shall pay for medical services for prisoners committed to the custody of the Department of Correction.

S1322 - BINGO - RAFFLES - Amends existing law to require charitable bingo and raffle operations to provide documentation of their charitable activities; to require minimum recordkeeping and other financial guidelines; to delete the authority for unincorporated associations to conduct charitable bingo and raffle operations; and to clarify the procedure for denying certain applications.

S1325 - CONSERVATORS - Amends existing law to revise the priority of who may be appointed conservator.

S1356 - SHERIFFS - Amends existing law to provide for certain training following election to the office of sheriff for the first time.

S1362 - ASSAULT AND BATTERY - Amends existing law relating to assault and battery to remove the requirement that certain victims be engaged in the performance of duties before a certain punishment shall be imposed; to provide punishment for violations against the person of specified former or present officials; to provide for imposing certain punishment for certain crimes with certain knowledge while certain victims are engaged in the performance of duties; and to provide punishment for battery upon a law enforcement officer while the victim is engaged in the performance of duties.

S1370 - CRIMES AND PUNISHMENTS - Amends existing law to provide that it shall constitute a felony for certain persons to induce, cause or permit a minor child to witness an act of sexual conduct.

S1382 - LIQUOR - Amends existing law to revise liquor license fee provisions; to provide for license renewal fees relating to year-round resorts; and to increase the maximum number of year-round liquor licenses that may be issued to owners, operators or lessees of facilities located and operated within the ownership or leasehold premises of year-round resorts.

S1385 - DISPOSAL OF PROPERTY - Amends existing law to revise provisions for disposal of property acquired by a county by tax deed; to revise procedures for notice to all parties in interest; to provide procedures for holding and disposing of excess funds; and to shorten the period of time when there is a delinquency on real property before a tax deed is made for such property.

S1438 - CONDUCTED ENERGY DEVICE - Adds to existing law relating to crimes and punishments to prohibit certain individuals from possessing a conducted energy device; to provide that use of a conducted energy device during the commission of a felony shall constitute a separate offense; to provide for enhanced penalties; to provide for separate and consecutive sentences; and to define a term.

S1449 - NAVIGATIONAL ENCROACHMENTS - Amends existing law relating to navigational encroachments to revise certain civil penalty provisions; to provide for the assessment of civil penalties in conjunction with other administrative actions; to provide a condition for the assessment of civil penalties; to provide for civil penalties where violations cause harm to water quality, fisheries or other public trust values; to provide liability for specified expenses; and to provide that designated actions shall not relieve persons committing violations from civil actions and damages.

H0338 - MILITARY DIVISION - RULES - Adds to existing law to provide that the Military Division is authorized to promulgate rules.

H0339 - MILITARY - Amends and repeals existing law to provide that the membership requirements for the state militia be gender neutral; to delete obsolete provisions of law relating to the state militia; and to allow national guard or reservists who are state employees to have 120 hours off for military service annually.

H0348 - LIQUOR STORE SALES - ELECTION DAY - Amends existing law to eliminate the prohibition on the sale of alcoholic liquor on election day.

H0352 - CRIMINAL RECORDS REVIEW - Amends existing law relating to the Idaho State Police to clarify the authority to establish and collect fees for processing requests for criminal records review of state and federal files.

H0371 - INTEROPERABILITY EXECUTIVE COUNCIL - Amends existing law to transfer the Idaho Statewide Interoperability Executive Council from the Idaho Bureau of Homeland Security to the Military Division.

H0381 - SEXUAL PREDATORS - Amends existing law relating to probation and parole supervision to require electronic monitoring of violent sexual predators placed on probation or parole; and to provide a penalty for unlawful interference with any electronic monitoring equipment.

H0384 - HIGHER EDUCATION FACILITIES - MATCHING FUNDS - Adds to existing law relating to higher education facilities to provide legislative intent; to provide for the creation and operation of the Higher Education Facilities Matching Fund; to require matching funds raised from nonstate sources; to provide for the appropriation and use of the fund; and to provide for rulemaking authority.

H0409 - SHORTHAND REPORTERS - Amends and repeals existing law to provide intent; to provide that a certificate to practice shorthand reporting is not transferable; to provide that nominees to the Certified Shorthand Reporters Board must possess a current certified shorthand reporter license; to revise titles and elections of board officers; to revise recordkeeping; to authorize the board to determine qualifications of applicants for certificate renewal and to issue temporary permits; to authorize the board to refuse to issue temporary permits and to refuse to issue, refuse to renew or otherwise discipline any certificate or permit; to revise applicant residency; to provide renewal and reinstatement of certificates; to revise consequences of failure to renew certificates annually; to revise judicial review; and to provide for deposit of fees.

H0515 - SHOOTING RANGES - Adds to existing law relating to shooting ranges to provide for the establishment of criteria for the operation and use of state outdoor sport shooting ranges; to provide noise provisions and sound pressure measurements; to prohibit certain public or private nuisance actions; to require noise buffering or attenuation for certain new use; and to provide for the preemption of certain local governmental law.

H0543 - IDAHO EDUCATION NETWORK - Adds to existing law relating to the Idaho Education Network to state legislative findings; to require the State Department of Education to perform the duties assigned to it relating to the Idaho Education Network; to provide legislative findings; to define "Idaho Education Network (IEN)"; to provide for administrative oversight of the Idaho Education Network by the Department of Administration; to specify duties of the Department of Administration, including implementation of the goals and plans of the Idaho Education Network; to specify duties of the State Department of Education; to provide for management of site operations; and to create the Idaho Education Network Fund.

H0548 - COLLEGE SAVINGS PROGRAM - Amends and adds to existing law to revise powers and duties of the State College Savings Program Board; to revise college savings program requirements; to revise limitations of the college savings program chapter; to allow policies instead of rules; and to provide procedures for unclaimed amounts.

H0559 - HEALTH AND WELFARE - Amends existing law to revise duties of the Department of Health and Welfare regarding the availability of certain materials about abortion on their website; and to provide duties of certain physicians regarding notice of these materials to the pregnant patient.

H0604 - SHOOTING RANGES - Amends and adds to existing law to provide for certain limitations regarding regulation of shooting ranges; to revise local regulation of sport shooting ranges; to further define terms; and to provide for preemption of local authority for noise standards and zoning regarding sport shooting ranges.

H0606 - FEDERAL REAL ID ACT OF 2005 - Adds to existing law relating to the implementation of the Federal REAL ID Act of 2005 to state findings of the Legislature; to direct the Idaho Transportation Board and the Idaho Transportation Department not to implement the provisions of the REAL ID Act of 2005; and to provide for security of driver's licenses and identification cards.

H0607 - PUBLIC SCHOOLS - Amends existing law relating to public school funding to revise the basis for calculating pupil tuition-equivalency allowances.

S1022 - HUNTING - Amends existing law relating to hunting to provide for the revocation of hunting privileges based upon certain felony convictions relating to homicide.

S1066 - MANSLAUGHTER - Amends existing law to revise the definition for involuntary manslaughter.

S1151 - TORT CLAIMS - SUPERVISORY PHYSICIANS - Adds to existing law relating to tort claims against governmental entities to provide that supervisory physicians shall be considered employees for purposes of tort claims act insurance coverage; to define terms; to provide that specific liability exceptions and limits shall be inapplicable in certain cases; and to provide that certain claims against supervisory physicians shall not be subject to medical malpractice.

S1155 - MODULAR BUILDINGS - Amends, repeals and adds to existing law relating to modular buildings to revise definitions; to revise inspection fee references for modular buildings; to repeal provisions relating to modular buildings, commercial coaches and reciprocity; to provide for a Modular Building Advisory Board; to set forth fees; to provide for an insignia of approval; to require reapproval for modifications; to provide for reciprocity; to provide that violations are misdemeanors; to set forth penalties; and to revise terminology.

S1157 - PUBLIC BENEFITS - Adds to existing law relating to public benefits to provide legislative findings; to define terms; to require the verification of lawful presence in the United States of natural persons in order to receive public benefits; to provide exceptions; to provide for verification procedures; to permit rulemaking by agencies and regulation-making by political subdivisions; to provide for penalties; and to permit certain information to be accepted as prima facie evidence of lawful presence in the United States.

S1161 - BAIL - Amends existing law relating to bail to revise provisions applicable to the forfeiture of bail; and to revise timelines.

S1164 - SEARCH WARRANTS - Amends existing law relating to warrants to remove language requiring search warrants to be served with the officer present; and to allow for service of warrants by specified means.

S1181 - PUBLIC SAFETY OFFICERS - Adds to existing law relating to public safety officers to provide a supplemental disability benefit; and to provide for insurance eligibility for certain public safety officers and their spouses and dependents.

SCR102 - AMERICAN SIGN LANGUAGE - Stating findings of the Legislature and encouraging Idaho public schools and public and private institutions of higher education to recognize American Sign Language coursework for foreign language credit and encouraging the State Board of Education, the State Department of Education and the Council for the Deaf and Hard of Hearing to confer, collaborate and provide information for the inclusion of American Sign Language as foreign language credit in high school and to determine ways and incentives in which public and private institutions of higher education might be encouraged to accept successfully completed coursework in American Sign Language for foreign language credit.

SCR103 - CHILDREN - DEAF/HARD OF HEARING - Stating findings of the Legislature and encouraging the Legislature to recognize the unique educational needs of children who are deaf and hard of hearing.

H0054 - DRIVER'S LICENSES - Amends existing law to clarify the restriction on issuing a license, permit or privilege to drive to habitual drunkards and persons addicted to the use of narcotic drugs, and persons afflicted with or suffering from mental disability or disease.

H0055 - NATIONAL GUARD - Amends existing law relating to the National Guard to provide reemployment rights for an Idaho employee who is a member of the National Guard of another state and who is called into active service by the governor of that state; to revise definitions; and to provide for an emergency proclamation by a governor.

H0126 - SUBPOENAS - Repeals existing law relating to service of subpoenas on concealed witnesses.

H0180 - LIQUOR ACCOUNT - Amends existing law to provide for distributions from the liquor account to the Substance Abuse Treatment Fund, to the Drug Court, Mental Health Court and Family Court Services Fund and to the Drug and Mental Health Court Supervision Fund; to create the Substance Abuse Treatment Fund and to provide for what moneys in the fund may be utilized; to create the Drug and Mental Health Court Supervision Fund and to provide for what moneys in the fund may be utilized; and to provide for distribution of revenues from the tax on beer and the tax on wine to the Substance Abuse Treatment Fund.

H0184 - MINIMUM WAGE - Amends existing law to revise minimum wage provisions.

H0186 - COMPUTER INFORMATION - Adds to existing law relating to computer information agreements to provide that a choice of law provision that would result in the application of the Uniform Computer Information Transactions Act is voidable; to permit objection to the application of the Uniform Computer Information Transactions Act; to provide that the section may not be varied or invalidated by agreement of the parties; and to define terms.

H0194 - DISTURBING THE PEACE - Amends existing law relating to disturbing the peace to provide the misdemeanor penalty for maliciously and willfully disturbing the dignity or reverential nature of any funeral, memorial service, funeral process, burial ceremony or viewing of a deceased person.

S1251 - COURTS - Repeals existing law relating to courts requiring persons to appear at appointed places.

S1301 - SEX OFFENDERS - Amends existing law to increase the mandatory minimum term of confinement for certain sex offenders to fifteen years; and to provide for a mandatory minimum of life imprisonment for certain repeat sex offenders designated as violent sexual predators.

S1316 - PUBLIC SCHOOLS - Adds to existing law relating to educational interpreters and public schools to provide a short title; to provide legislative findings; to define terms; to provide for qualifications for educational interpreters; to provide exceptions; to provide for continuing training requirements; and to provide the State Board of Education with rulemaking authority.

S1335 - PROBATE CODE - Amends existing law relating to the Uniform Probate Code to revise the definition for "interested person."

S1356 - DOMESTIC VIOLENCE - Amends existing law relating to domestic violence crime prevention to increase the maximum effective period for protection orders in certain cases; and to revise the limitations a court may impose in a protection order; and to provide that immediate and present danger exists where there is reasonable cause to believe bodily harm may result.

S1367 - MOTORCYCLES - TRAFFIC SIGNALS - Amends existing law relating to motor vehicle traffic-control signals legend to provide a condition under which  the driver of a motorcycle may proceed through a steady red traffic-control signal after coming to a full and complete stop at the intersection; and to specify when such action is not a defense to a violation of the law.

S1407 - JUDICIAL DISTRICTS - Amends existing law to increase the number of district judges and resident chambers in the First and Third Judicial Districts.

S1414 - CRIME VICTIMS - Amends existing law relating to crime victim compensation to define "extenuating circumstances"; to provide that a victim found to have extenuating circumstances is eligible for a maximum mental health benefit of $25,000; and to provide for reevaluation of qualifications.

H0533 - DEATH PENALTY - Amends existing law to provide for the death penalty for murder in the perpetration of certain sexual crimes.

H0534 - FELONIES - STATUTE OF LIMITATIONS - Amends existing law to revise statute of limitations provisions applicable to specified felonies.

H0545 - WATER RIGHTS ADJUDICATION - NORTHERN IDAHO - Adds to and amends existing law relating to water to provide for Northern Idaho water rights adjudication; to revise fee provisions for filing notice of claims with the Director of the Department of Water Resources; to provide legislative findings relating to accomplished transfers and the public interest regarding Northern Idaho adjudications; to provide that certain changes of place of use, points of diversion, nature or purpose of use, or period of use of a water right may be claimed in the Northern Idaho adjudications; and to provide for objections to recommendations for specified accomplished changes.

H0601 - VETERAN MOTORCYCLE LICENSE PLATE - Amends existing law relating to the military veteran motorcycle license plate to revise the date of availability of the plate; and to revise the provisions for approval of the plate design and numbering system.

H0627 - ISTARS TECHNOLOGY FUND - Amends existing law relating to the ISTARS Technology Fund to reference payments made by credit card or debit card; to allow for the designation of moneys for certain technologies; and to provide for the deposit of certain payments into the ISTARS Technology Fund for specified uses.

H0633 - DRUG HOTLINE FEE - Adds to and amends existing law relating to drug enforcement to provide for a drug hotline fee for drug violations; and to provide for the use of certain moneys to support a twenty-four hour anonymous hotline and reward system for the reporting of drug violations.

H0713 - SEX OFFENDERS - SCHOOL CHILDREN - Adds to existing law to prohibit access to school children by any person currently registered or required to register under the Idaho Sex Offender Registration Act; to provide exceptions; to provide a penalty; and to allow more stringent safety and security requirements by school districts.

H0731 - INCOME TAX CREDIT - Amends existing law to provide an income tax credit for charitable contributions made to Idaho Drug Free Youth Inc. or its foundation.

H0750 - SCHOOLS - BULLYING - Amends and adds to existing law to provide that superintendents and principals may temporarily suspend pupils for student harassment, intimidation or bullying; to provide additional powers and duties for boards of trustees; and to provide that any student who commits or conspires to commit an act of harassment, intimidation or bullying may be guilty of an infraction.

H0780 - DEVELOPMENT IMPACT FEES - Amends existing law to revise the procedure for the imposition of development impact fees; to increase the number of years that a governmental entity may hold development impact fees before expending them from five to eight years; and to increase the maximum number of years that collected development impact fees may be held from eight to eleven years before they need to be expended.

HJM013 - NO CHILD LEFT BEHIND - Stating findings of the Legislature and urging Congress to support federal legislation that will enhance specified aspects of the "No Child Left Behind Act."

S1013 - JUVENILE CORRECTIONS - Amends existing law relating to the Juvenile Corrections Act to provide a correct code reference.

S1014 - SERIOUS CRIME - Amends existing law to revise the definition for "serious crime."

S1015 - JUVENILE CORRECTIONS - Amends existing law relating to the Juvenile Corrections Act to clarify that courts have jurisdiction for offenses that occur in the state of Idaho.

S1016 - COURTS OF RECORD - Amends existing law relating to courts of record to provide a correct code reference.

S1038 - CRIME VICTIM BENEFITS - Amends existing law relating to crime victim compensation benefits to increase benefit amounts; to provide for the payment of benefits for cremation expenses and actual expenses of transportation of the victim's body; and to expand the eligibility for benefits paid as a result of criminally injurious conduct. 

S1073 – MARRIAGE SETTLEMENTS - Amends existing law relating to marriage settlements to provide for the recording of summaries of contracts and to provide the effect of such recording.

S1197 - DNA SAMPLES - Amends existing law to revise provisions applicable to persons required to provide a DNA sample and thumbprint to the Idaho State Police.

H0016 - PROFESSIONAL-TECHNICAL EDUCATION - Amends existing law relating to the State Board for Professional-Technical Education to provide consistency in language relating to powers of the board regarding removal of employees.

H0080 - CONSERVATORS - Amends existing law to set forth requirements for reports submitted by conservators.

H0130 - MOTOR VEHICLE COLLISION REPORT - Amends existing law relating to records exempt from disclosure to provide that any person involved in a motor vehicle collision, which is investigated by a law enforcement agency, that person's authorized legal representative and the insurer shall have a right to a complete unaltered copy of the impact report, or its successors, and the final report prepared by the agency.

H0204 - COURT JURISDICTION - Amends existing law relating to court jurisdiction to provide that under certain circumstances the court may decide whether to place a defendant on probation or release within a reasonable time after the one hundred eighty day period of retained jurisdiction has expired.

H0315 - TEACHERS - Amends existing law relating to support programs for employees of school districts to provide additional authority to school trustees to provide support for teachers in their first two years in the profession; and to delete the requirement that school districts provide support programs for certificated employees during their first three years with the district.
